My husband died in an explosion while working on an offshore oil platform off the Louisiana coast. He left behind me our three minor children. Maritime work is considered one of the world’s most dangerous occupations. When a family has lost a loved one to a heavy machinery accident, explosion, chemical exposure or slip and fall while working aboard a rig, platform, barge, dredge, tug boat or fishing vessel, there are several ways to recover for your losses, including a lawsuit filed under The Jones Act. A widow and surviving dependents might also choose to seek benefits under the Longshore and Harbor Workers’ Act or the Death on High Seas Act. However, compensation under DOSHA is limited to monetary losses and does not provide recovery for pain and suffering, loss of companionship, earning potential or future medical expenses.
